Heard's team have also said the jury was not vetted properly
Amber Heard has called for the defamation verdict that saw ex-husband Johnny Depp awarded damages of $10m to be tossed out, citing a fake juror and unsupported claims.
While the million-dollar defamation case sided with Depp last month, the 36-year-old actor filed a 43-page memorandum on Friday that detailed a host of reasons the verdict should be thrown out.
According to the papers, Depp "proceeded solely on a defamation by implication theory, abandoning any claims that Ms. Heard's statements were actually false." For instance, Heard's team argue that Depp, 58, never lost Pirates of the Caribean because of Heard's 2018 Washington Post op-ed.
Heard's legal counsel Elaine Bredehoft also claimed that Depp's team said they would focus on the events after the opinion piece but instead recalled moments from back in 2016. She also believes that the damages awarded to Depp were not fair, despite the jury's split verdict. Ultimately, they are looking for a retrial or for the verdict to be tossed completely.
Heard's team also believed that jurors were not properly vetted, as in one case, Juror 15 appears to have been born in 1945.
But 15 "was clearly born later than 1945. Publicly available information demonstrates that he appears to have been born in 1970."
The statement added: "This discrepancy raises the question whether Juror 15 actually received a summons for jury duty and was properly vetted by the court to serve on the jury."
One of Depp's lawyers, Benjamin Chew, rebuked the claims and said their motion was "what we expected, just longer, no more substantive."
